LIABILITY RELEASE AND TERMS OF ATTENDANCE

Please carefully read the following terms and conditions relating to your participation in Brian Fullerton’s Lawntrepreneur Academy LIVE 2024 event, which is conducted by Brian Fullerton and Mowtivated Media LLC ("Promoter"). By registering for the conference at any one of our locations ("Office"), you (the "Attendee") signify your acceptance of an obligation to these terms and conditions. If you have objections to the following Terms and Conditions, you should not register for or attend the conference.

Attendee Conduct

Promoter requires all Attendees to be respectful and professional to our staff, location hosts, speakers, and other attendees and their guests or families throughout the conference, even during non-scheduled downtime and breaks. Promoter reserves the right to ask Attendee and/or their guests to leave the conference room and hotel immediately should they be deemed rude, uncooperative, unprofessional, intoxicated, or in possession of alcohol or any illegal substance. In such case, the Attendee's tuition/fees for the conference will not be reimbursed under any circumstances and they will not receive any future products, services, or correspondence.

Attendee further agrees to indemnify and hold harmless Brian Fullerton, Promoter, and all facets of Lawntrepreneur Academy Conference from any damages to Suburban Collection Showplace Convention Center, Hyatt Place Detroit/Novi Hotel, or surrounding environment / Properties. Attendee agrees to be held personally responsible for costs of any levied fines, charges, false alarms, damages, either direct or inconsequential caused by themselves or minors bound to Attendee to the Convention or Hotel space and agrees to release Brian Fullerton, Promoter, Suburban Collection Showplace, and Hyatt Place Detroit/Novi of any and all liability and furthermore agrees to be held accountable to all permissible State of Michigan and local laws.

Liability Waiver

While we take every possible measure to ensure Attendee safety at the conference, we cannot control everything. For this reason, Attendee is legally responsible for their safety and behavior and agrees to, and is held legally liable to, the following statements:

I, the willing Attendee of the conference, hereby accept all risk to my health, including, but not limited to, personal illness, injury, or death, that may result from participating in the conference. I hereby release Brian Fullerton, and their officers, employees, interns, contractors, sponsors, and representatives from any and all liability to me, my personal representatives, estate, heirs, next of kin, and assigns for any and all claims and causes of action for loss of or damage to my property that may result from or occur during my participation at the conference, whether caused by negligence of the Promoter, its governing board, officers, employees, representatives, or otherwise. I further agree to indemnify and hold harmless Promoter, Brian Fullerton, and any third-party company from liability for the injury or death of any person(s) and damage to property that may result from my negligent or intentional act or omission while attending and participating in the conference. Under no circumstances will Promoter or Brian Fullerton or their assigns be held liable for my injury or death or any loss or damage to my personal belongings resulting from my participation in the conference.

Should I require emergency medical treatment as a result of accident or illness arising during my attendance and participation in the conference, I consent to such treatment, I acknowledge and I agree to be financially responsible for any medical or legal bills that may be incurred as a result of emergency medical treatment. I will notify Brian Fullerton verbally and in writing if I am at any time injured prior to, during, or immediately following the conference, in my travels or attendance, or if I have medical conditions about which emergency medical personnel should be informed; however, I understand that Brian Fullerton is not legally obligated to act on that information in any way or to provide any medical service whatsoever to me. I agree that if l have any medical or psychological conditions that may hamper me from fully and healthfully participating in the conference, that I will notify Brian Fullerton and/or the Promoter, the Promoter retains the right to ask that I not participate in portions of or the entirety of the conference.

Liability Disclaimer: No Professional Advice

The information contained in or made available by the Promoter, Brian Fullerton, or any third- party through the conference or their websites or services cannot replace or substitute for the services of trained professionals in any field, including, but not limited to, mental, financial, medical, psychological, or legal fields. The promoter does not offer any professional personal, medical, financial, or legal advice and none of the information contained in the conference should be confused with such advice. Neither Promoter, Brian Fullerton, nor their assigns, sponsors, speakers, partners, contractors, or any of their affiliates will be liable for any direct, indirect, consequential, special, exemplary, or other damages to the Attendee or the Attendee's business, including economic loss, that may result from participation in the conference or from the use of, or the inability to use, the materials, information, or strategies communicated through the conference or any products or services provided pursuant to the conference, even if advised of the possibility of such damages. Under no circumstances, including but not limited to negligence, will Promoter or Brian Fullerton be liable for any special or consequential damages that result from attendee's participation in the conference. To be clear: You, the Attendee, alone are responsible and accountable for your decisions. actions, and results in life, and by your participation in our conference, you agree not to attempt to hold us, the Promoter or Brian Fullerton, liable for any decisions, actions, or results that you make or experience in business or in life due to your participation in this conference at any time, under any circumstance.

Confidentiality and Non-Compete

Attendee hereby understands that the tools, processes, strategies, materials, and information presented in the conference are confidential, copyrighted, and proprietary to Brian Fullerton, the Promoter and Authorized Third-Parties, and agrees not to record, duplicate, distribute, report on, teach or train from the conference materials in any manner whatsoever without the express written permission of Promoter. Attendees may not use any device to video, photograph, or record any aspect of the conference. Attendees who do not abide by this policy will be asked to destroy any recorded materials and may be asked to leave the conference and will not be eligible for a refund. Attendees may not report on any of the concepts taught at the event, including providing a summary or review of the event on/in any media outlets, blogs, websites, or stages without written permission from Promoter.

Youth Policy

Children under the age of 12 are not permitted to attend, and teens between 13-17 years old must be accompanied by a parent or guardian throughout the entire event. Registered youth must show proof of age and a valid ID at registration.

Adult Language

During our conference, we will discuss several adult topics relating to personal and professional growth. We will also occasionally use adult or profane language to emphasize a point or connect with or surprise the audience (though we will never be lewd and we will always use tact and discretion in doing so). The Promoter does not allow anyone under the age of thirteen (13) into the conference given the adult topic and content. Participants who are uncomfortable with such topics or language should not attend the conference and will not receive a refund should they request one based on an offense to such language under any circumstances.

Audio/Visual Release

By participating in the conference, attendee understands that portions of the conference’s live events may be recorded in video and audio and/or captured film and/or digital photographs. Attendee agrees that the Promoter and its assigns have the right and permission to use such recordings and photographs should they include Attendee's name, likeness, voice, biographical details, testimonial, or photograph for marketing, advertising, or any other purpose in any media or format, online and/or offline, now or hereafter without further compensation, permission, or notification to the Attendee. Attendee understands and agrees that all recordings from the Promoter's events are the exclusive rights of the Promoter and Attendee does not ask for or expect compensation for the use of recordings or photographs in which Attendee appears or speaks. Promoter owns all rights to any audio, video, and/or photographs captured during the Promoter's conference or at any of the Promoter's other live events. Attendee is not permitted, under any circumstances, to film, record, or capture audio or video footage during the conference. Attendees who violate this may be asked to delete the footage, discontinue the use of the device (such as a recording pen). and/or may be removed from the conference without refund.

Waiver of Liability Relating to Coronavirus/COVID-19

The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is reported to be extremely contagious. The state of medical knowledge is evolving, but the virus is believed to spread from person-to-person contact and/or by contact with contaminated surfaces and objects, and even possibly in the air. People reportedly can be infected and show no symptoms and therefore spread the disease. The exact methods of spread and contraction are unknown, and there is no known treatment, cure for COVID-19. Evidence has shown that COVID-19 can cause serious and potentially life threatening illness and even death.

Motivated Media LLC cannot prevent you [or your child(ren)] from becoming exposed to, contracting, or spreading COVID-19 while attending Lawntrepreneur Academy LIVE 2024 or at the Suburban Collection Showcase premises. It is not possible to prevent against the presence of the disease. Therefore, if you choose to attend Lawntrepreneur Academy LIVE 2024 and/or enter onto Suburban Collection Showplaces’ premises you may be exposing yourself to and/or increasing your risk of contracting or spreading COVID-19.

ASSUMPTION OF RISK: I have read and understood the above warning concerning COVID-19. I hereby choose to accept the risk of contracting COVID-19 for myself and/or my children in order to attend Lawntrepreneur Academy LIVE 2024 and enter the Suburban Collection Showplaces’ premises.

WAIVER OF LAWSUIT/LIABILITY: I hereby forever release and waive my right to bring suit against Mowtivated Media, Lawntrepreneur Academy LIVE 2024, Suburban Collection Showplace, and its owners, officers, directors, managers, officials, trustees, agents, employees, or other representatives in connection with exposure, infection, and/or spread of COVID-19 related to attending this in person live event. I understand that this waiver means I give up my right to bring any claims including for personal injuries, death, disease or property losses, or any other loss, including but not limited to claims of negligence and give up any claim I may have to seek damages, whether known or unknown, foreseen or unforeseen.

Cancellation Policy

Once Attendee registers for the conference, we make extensive arrangements and investments while anticipating their tuition and attendance, and, in the case of their cancellation, If you, the Attendee, are unsure of whether or not you can attend the event, please do not register. If you, the Attendee, must request a refund and are unable to attend the conference, Brian Fullerton and the Promoter will be happy to provide you with one. However, if you are within the 30-Day window of the live event, a refund will NOT be available.

Note: The reason we have a cancellation policy like this is because each conference sells out and when an Attendee cancels we have to manage the administration challenges as well as gear up the marketing machine to fill the spot. This costs us substantial time and resources to process a refund payment, to refund the promoter or affiliate from which the Attendee signed up, to communicate all this with Brian Fullerton, the Attendee, and the promoter. Given the number of our Attendees, it’s important for us to maintain this policy. Attendees can request cancellations or attend a future event via the correspondence information below.

Review and Jurisdiction

These Terms will be governed by and construed in accordance with the laws of the State of Michigan. Attendee agrees that any dispute that arises out of or relates to these Terms Will be resolved via non-binding mediation in the State of Michigan via a professional mediator obtained by the Promoter and if a successful mediation is not reached, to binding arbitration arbitrated in the State of Michigan in accordance with the policies set forth by the American Arbitration Association. If any of these Terms of use are found unlawful, void, or for any reason unenforceable, then that provision will be considered severable from the remaining terms of use, and will not affect the validity and enforceability of the remaining provisions.

Additional Cancellation/Refund Information
Please note that the speaker lineup is not guaranteed, as personal events and situations arise that may limit their ability to attend the event. We will however do our best to rebook that speaker with someone else to continue to add incredible value to the show. 

Ticket Refunds:
Please note that due to the nature of this in person event, refunds with NOT be offered after October 2nd 2024. Any ticket registered for LAL 2024 that can not be attended will NOT receive a refund, but will be granted a full live event replay instead. Due to the overhead, administration, costs and availability of an in person live event, register agrees and understands that a refund will not be granted in any case after an October 2nd 2024 cut off.
